This agreement is between Noble Phoenix LLC, located at 631 Leeman Dr, Akron, OH 44319, and the client who purchases any provided services.

Our Terms & Conditions become effective upon:

• Acceptance of our Statement of Work (SOW) or Project Proposal.
• Placement of an order.
• Signing a contract (if required).
• Initiation of design/development work.
• Payment for services.

By purchasing services from Noble Phoenix LLC, you accept these terms, which apply to design, printing, web services, domains, and hosting. These terms override any prior agreements. Updates to these terms may occur, and clients will be notified via email.

By placing an order for products or services offered by NOBLE PHOENIX LLC, you acknowledge and accept the terms outlined in this document. These services encompass, but are not limited to, design, printing, web services, domains, and hosting, all of which are subject to these new terms.

These updated terms override any previously signed Terms & Conditions you may have received or signed.

By accessing the services, you agree not to utilize this document to challenge or contradict any provision(s) term(s) in the contract you have previously signed.

Reviewing this document is a mandatory requirement. However, accepting these terms and conditions through postal mail, in person, or via email (with a link to view), or by accessing the Services is also considered an agreement to our Terms & Conditions.

You acknowledge and agree that we have the right to modify these Terms & Conditions at any time without requiring your signature. It is your responsibility to stay informed about any updated Terms & Conditions. We will notify you of such changes via email. Please note that these modifications do not impact your legal rights as outlined by the applicable statutes.

As the economy is constantly evolving, our Terms & Conditions remain dynamic. Therefore, we may send you monthly emails containing relevant updates pertaining to your business. These updates could include information about price adjustments, ICO reminders, and revisions to our Terms & Conditions.

1. Artwork

1.1 Creation Process

• Mock-ups will be designed based on the client’s SOW.
• Minor modifications (colors, fonts, imagery) are not chargeable.
• Full design layout changes beyond the first draft will incur additional charges.
• Signed-off designs cannot be modified without additional fees.

2. Web Design

2.1 Process & Sign-off

• Web design is based on the SOW.
• Minor changes (colors, fonts, minor CSS) are free.
• Structural or major design changes post sign-off are chargeable.
• The client cannot alter the signed-off design without our consent.

3. Development

3.1 Technologies & Custom Features

• We develop websites using HTML, CSS, JavaScript, and modern frameworks.
• Custom functions are built as per the SOW.
• Post-handover, we are not liable for issues caused by third-party modifications.
• Source files are not provided.

4. Printing & Graphics

4.1 Responsibilities & Liabilities

• Text must be submitted in DOCX, TXT, or PDF format.
• We use stock images unless the client provides specific assets.
• We provide final, print-ready files but do not hand over source files.

5. Changes & Revisions

5.1 Change Requests

• Minor changes: 1 batch allowed, free of charge within 5 days.
• Major changes: Additional fees apply and may delay the project.
• Post-launch changes within 30 days are limited to minor edits only.
• Beyond 30 days, changes are billable at our hourly rate.

6. Testing & Compatibility

• Websites are tested on major browsers (Chrome, Edge, Firefox, Safari).
• Mobile testing is done on iOS & Android devices.
• We do not guarantee compatibility with all browsers or operating systems.

7. SEO

• We submit sites to search engines but do not guarantee rankings.
• Clients are responsible for SEO strategies & marketing.

8. Domains & Hosting

• Annual renewals apply for domain & hosting services.
• Clients can transfer domains but may incur a $25 transfer fee.
• We are not liable for third-party hosting issues.

9. Support & Maintenance

• 21-day free support post-launch for minor fixes.
• Extended support requires a paid maintenance plan.
